Attend in person at the Municipal Center or watch on TV to learn more about trees, finances, parades, parties, names, numbers, and wireless agreements for town building tops. A discussion of concerns regarding the number and behavior of people who gather in the Harmony Lot is also scheduled.

The following will summarize those items on the Agenda for the Tuesday, May 16, 2006 Selectboard Meeting.

11A. Outside Consumption Permit -- Adagio's has requested an Outside Consumption Permit for their establishment on Main Street. They plan to have the same use as the prior owners.

Requested Motion: to approve the Outside Consumption Permit for Adagio's on Main Street as presented.

11B. First Class Liquor License . In preparation for their new establishment, 99 Restaurant has asked for a First Class Liquor License for 1184 Putney Road. The approval will be contingent on a clear record check.

Requested Motion: to approve the First Class Liquor License for 99 Restaurant at 1184 Putney Road contingent on a clear record check.

12A. Proclamation. For the second year in a row, Brattleboro has been named A Tree City USA. In honor of the award, the Brattleboro Tree Advisory Board & Brattleboro Trees Please celebrated by planting a tree at Memorial Park on Thursday, May 11th and asked that a proclamation for Arbor Day be drafted and read and later ratified at the Board's next meeting.

Requested Motion: to ratify the Proclamation for Arbor Day on May 11th, 2006, be approved as presented.

12B. Annual Financial Plan - This plan reports to the State the funds provided by the Town to address street and road repair and maintenance during the 2006-2007 budget year. This information is required by the State to insure that the Town is committing an amount equal to the State Highway Assistance, toward road and highway projects. As a result of discussion at the last meeting, the appropriate changes have been made to the Plan.

Requested Motion: to approve the Annual Financial Plan as amended from the last meeting.

12C. VTRANS Safety Improvements -- Approve Agreement for Canal Street. Our Pubic Works Director will discuss a proposal from the Vermont Agency of Transportation to improve traffic safety and flow on several portions of Canal St., (Route 5). All work will be designed and funded by the State.

Requested Motion: To approve the Agreement with VTrans for Safety Improvements on Canal Street to be funded totally by VTrans.

12D. Parade Permit. The annual request by the Chamber for the 4th of July parade is before the Board for approval.

Requested Motion: to approve the 4th of July Parade as presented.

12E. Parade Permit. Chris Chapman will be attending the meeting seeking the Board's approval of the Hospital's bicycle ride fund-raiser. The ride is on August 26th, beginning at 8am, and will run from Brattleboro Memorial Hospital via Canal St. to Main St. and Route 30. Cyclists will then have a choice of riding one of three routes before returning thru Main St. to finish at the hospital. As in past years, the parking lanes on the west side of Main St. will be used as a bike lane for returning riders. Due to cost concerns by the town last year, it is anticipated that Hunter North will be providing the escort service and coverage of intersections this year.

Requested Motion: to approve the BMH Second-Century Ride on August 26, 2006 as presented.

12F. Block Party. A request from Myrtle Street residents to close the entire length of the street, has been received for their annual Block Party scheduled for Saturday, June 10th, from 4pm to 9pm. Your approval is requested.

Requested Motion: to approve the request for a Block Party on Myrtle Street on Saturday, June 10th, from 4pm to 9pm.

12G. Street Name. A request to remove Memorial Court from the list of street names is before the Board for approval. The former Christian Heritage School, recently purchased by the Winston-Prouty Center is the only building located on the street. The current name is in conflict with Memorial Park directly across the road. The request is to renumber it 72 Guilford Street.

Requested Motion: to approve the address change from Memorial Court to 72 Guilford Street.

12H. Town Finances. Barb Sondag will provide the monthly update of Town Finances.

12I. DOC Grant. Brattleboro Community Justice Center Director Ariel Brugger will meet with the Board to seek approval for application to renew the current grant from the Vermont Department of Corrections that funds the Justice Center and its many programs, such as Community Mediation, Pre-Charge, the four Reparative panels, and Offender Reentry program would continue to be funded from a new grant of $68,450 from the Department of Corrections, and carryover of $73,275 in current budget funds from Offender Reentry Program.

Requested Motion: to approve the application to renew the FY06-07 DOC Grant for the Justice Center as presented.

12J. Harmony Lot -- Update Selectboard members Dick DeGray and Greg Worden will update the Board on the first meeting of the ad hoc group of young adults, citizens, and adults which is intended to identify issues and resolutions to recent concerns regarding the number and behavior of young adults who gather in the Harmony Lot.

12K. Wireless Antenna on Municipal Center. The Selectboard is asked to approve a lease agreement with Optima Computer of Brattleboro to install a small antenna on the Municipal Center roof as part of a new wireless internet network that they are building in the downtown Brattleboro.

Requested Motion: to approve the Lease Agreement for Optima Computers to place a Wireless Antenna on the Municipal Center roof.

12L. Ordinance Amendment. The first reading of a proposed amendment to change the requirements for issuing an Entertainment Permit is before the Board. Staff has been dealing with several situations in the last two years resulting from a loophole in both State Statute and the Town entertainment ordinance. State Statute currently allows patrons of restaurants or establishments not holding a State and Town liquor license to bring liquor into the business as long as the liquor is not served by the restaurant and is consumed by the patron. The current entertainment permit ordinance is only required if the restaurant or establishment holds a liquor license, allowing non-licensed establishments to not have an entertainment permit. The second reading/public hearing is scheduled for June 6, 2006.
