"Presumed Consent" Is NOT "Informed Consent" And The VT State Legislature Should Be Ashamed Of Themselves!


PRESUMED CONSENT OF ORGAN DONATION. OH, REALLY? WHAT A CREEPY WAY FOR THE STATE OF Vermont TO MAKE MONEY because "presumed consent" is NOT "informed consent"!

This Act shall take effect on January 2, 2016. Bill as introduced, H. 57 It is hereby enacted by the General Assembly of the State of Vermont: Sec. 1. 18 V.S.A. chapter 110A is added to read: CHAPTER 110A. ANATOMICAL GIFTS § 5232. PRESUMED CONSENT All Vermont residents 18 years of age or older shall be presumed to consent to making an anatomical gift of some or all of their organs, eyes, tissues, or a combination thereof upon their death for the purpose of transplantation, therapy, research, or education.

§ 5231. DEFINITIONS As used in this chapter: (8) “Refusal” means a record created under section 5234 of this title that expressly states an intent to bar other persons from making an anatomical gift of an individual’s body parts.

OH really? And how many Vermonters will be given an opportunity to create such a record of refusal and how much will it cost them to do so? If it costs so much as one dollar, then this is extortion. HOW MANY PEOPLE WILL KNOW THEY HAVE TO CREATE A RECORD OF REFUSAL TO BE BURIED INTACT? Shouldn't it be the other way around, that ONLY if you have expressly chosen to give your body parts, then and only then they will take them? "Presumed" consent means that you MIGHT NOT KNOW THEY ARE HARVESTING YOUR BODY! THIS IS RAPE, JUST LIKE WHEN A YOUNG MAN "presumes consent" to force a woman to have sex just because she kissed him. This Bill is a clear violation of the United States Constitution and it violates the separation of Church & State, and it violates every known concept of "informed consent" and "meeting of the minds" when the majority of people will have no idea that Governor Peter Shumlin is harvesting their organs and selling them to the highest transplant bidder!

In this new Act, if you should die or become close to death (their favorite time for harvesting organs) BEFORE you are scheduled to get a new drivers' license, or if you don't drive, like many senior citizens and vulnerable disabled persons, then you probably will not know that your organs are going to be harvested by order of a Bill signed by Governor Peter Shumlin, without any payment to your estate or family, then sold to the highest organ transplant bidder.

ANATOMICAL GIFT ACT; DONOR REFUSAL; FORM The Commissioner shall provide a form which, upon the licensee’s execution, shall serve as a document of refusal to make an anatomical gift under 18 V.S.A. chapter 110 § 5234. An indicator shall be placed on the license of any person who has executed an anatomical gift refusal form in accordance with this section." "5239. RULEMAKING The Commissioner of Health may adopt rules pursuant to 3 V.S.A. chapter 25 as needed to carry out the provisions of this chapter." Could we get the state legislators to state presumed prices per body part? Remember, they are going to TAKE your body parts WITHOUT your informed consent, and consider them a "gift" from you, and then SELL them to the highest bidder! For example, how much can the state of Vt get for Peter Shumlin's Penis when he dies, and can the State of VT sell it to a woman who wants it sewn on her groin during a sex change? Let's get each state senator who is a man to tell us how much we want the state of Vermont to sell HIS penis for, and if the State of Vermont can sell it to men, who think there's is too short, so they want a transplant for vanity, and not for medical necessity? Can we get the women in the state legislature to whether or not any of them were previously men, and how much would they buy a vagina for from the State of Vermont selling dead women's vaginas? How much money do you think the state of Vermont can sell Peter Shumlin's nose for when he's dead? We can presume he wants an open coffin for his family and daughters to view him with the nose removed?

Status of the bill

Whether intentional or not, Cris Ericson's report sounds as though this bill was passed and is scheduled to take effect on Jan, 1, 2016. The VT Legislative website reports that the bill has been referred to committee, that there have been no witnesses so far and no role call votes.

I agree with Ericson that mandatory organ donation is not consensual, even with an opt out. The term, "presumed consent" is Orwellian.

is not a humanitarian enterprise, this is all about itemized billing!

Cris Ericson need not be concerned that the State of Vermont will be selling organs. A source close to Shumlin assured this citizen journalist that, “all organ auctions under H. 57 will be conducted by private corporations.”

Privatization, explained our source, will satisfy conservatives “who will have no cause to cry, ‘socialism!’” He explained that the business arrangements will be structured in a manner “which benefits progressive initiatives such as education and healthcare.”

Ericson basically got it right when she lauded Shumlin for this visionary plan to enrich state coffers. But the details do need to be clarified. Under H. 57 the State of Vermont will not be selling organs: The state will be putting contracts out to bid so that private companies can compete for the Kidney Franchise, the Liver Franchise, the Heart and Lung Franchise, the Penis and Nose Franchise, and the Vagina Monologue Franchise.

Responding to Ericson, our unnamed source assured this citizen journalist that, “we do not anticipate ‘vanity’ penis purchases. Organ transplants -- particularly penis replacement -- is a serious matter and we expect penis replacement surgery to be used only as a last resort remedy for erectile disfunction.”

Currently, the State Auditor’s office is preparing a report on projected economic impacts of H. 57. The report is to be published prior the the roll call vote, but sections of the current draft have been leaked to this citizen reporter, including the following:

“Modern organ banks should be no different from other banks. Organs can be bundled into negotiable securities, so that investors can buy shares in Vermont Kidneys™, Vermont Livers™, and Vermont Spleens™. This will be good for the health of the economy.”

The draft report touts the program’s social benefits to low income Vermonters:

“Kidney debit cards can help vulnerable Vermonters, by providing cash now for the monetary value of future organ contributions. Of course, children must be protected, and no organ will be removed from a living child without the express, written consent of at least one parent.”

In a spontaneous, exclusive interview in the men’s room of the gold-domed Vermont Statehouse, the governor declared: “This Ericson lady has been up my ass and I am sick of it. I am not selling my penis, nor my great nose!”

Just as the governor was leaving, he turned and added: “Don’t get me wrong, now. I do have skin in the game.”

Why Not? We're Used To It

Why does this seem so far fetched coming from this state legislature. After all they usually take a left arm or 2 and a couple of pints of blood in taxation in this God forsaken Socialist state. They've just figured out a way to tax you when you die.

...she noticed that she was the subject of the operation.
...doctors were about to harvest her organs...

... It was covered by ABC News...

....Doctors falsely pronounced her dead by fraudulently claiming she had
suffered “cardiopulmonary arrest” and “irreversible brain damage.”...

... how a lot of the
organ harvesting in America actually gets done: patients that are on the
verge of death (but not yet actually dead) are simply “declared” dead, then
their organs are quickly removed, killing them for good....

... “donate” them actually means they
are donating their immensely valuable organs
to a for-profit system that’s
going to earn potentially millions of dollars off the organs of a single donor...

... the doctors
engaged in organ removal and organ transplants get wealthy....

... the profits are ongoing because transplant
recipients must also pay for a long course of organ transplant
anti-rejection drugs...

... to help people,
teach them to protect the organs... food
nutrition, exercise and healthy living....

This is a totally serious issue

I googled "presumed consent" and was rather amazed to find that this is not simply a Vermont initiative, but is part of a much larger effort. There are warnings by medical ethicists about the consequences of mandatory organ donation.

Opt-outs are notoriously subject to error, and using Orwellian language ("presumed consent") does nothing to change the reality that it is not about consent at all: It is a government mandate.

The Story of Colleen Burns

wow, I was all hyperventilatin and stuff and kind of exhausted after calling all those phone numbers and stuff and then I decided to google Colleen Burns and look at a different explanation than the one on sleuth journal and this is what I found out

While I sure wouldn't have wanted to be in Colleen's shoes it seems the story is more complicated than it appears as posted here and the doctors responsibilities as far as declaring her brain dead were a little more complicated than as posted here. I'm so shocked that there's a discrepancy. Guess I'll just go calm down now.

There has always been a

There has always been a charge for harvesting, transporting and/or disposing of non viable organs. That's not new. There is never a charge for the person receiving the donor organ. If you have your gallbladder removed the hospital charges you for not only the surgery but the disposal of your diseased gallbladder. Again, nothing new or insidious here- except for the actual costs of a hospital stay.
I don't understand why people aren't willing to donate their organs after death. What are you going to do with them once you're dead? So many lives can be saved - isn't that a good thing?

Please note that the Vermont Legislature
passed an organ donation law in

allows them to take your organs and

or have two witnesses swearing you do
not want

hospital to profit.

The problem is that they PRESUME that

and poor people are OFTEN not aware of this,

§ 5250g. Refusal to make anatomical gift; effect of refusal
(a) An individual may refuse to make an anatomical gift of the individual's body or part by:
(1) an advance directive executed pursuant to chapter 231 of this title;
(2) a record signed by:
(A) the individual; or
(B) subject to subsection (b) of this section, another individual acting at the direction
of the individual if the individual is physically unable to sign;
(3) the individual's will, whether or not the will is admitted to probate
or invalidated after the individual's death; or
(4) any form of communication made by the individual during the individual's
terminal illness or injury addressed to at least two adults,
at least one of whom is a disinterested witness.
(b) A record signed pursuant to subdivision (a)(2)(B) of this section must:
(1) be witnessed by at least two adults, at least one of whom is a disinterested witness,
who have signed at the request of the individual; and
(2) state that it has been signed and witnessed as provided in subdivision (1) of this subsection.
(c) An individual who has made a refusal may amend or revoke the refusal:
(1) in the manner provided in subsection (a) of this section for making a refusal;
(2) by subsequently making an anatomical gift pursuant to section 5250e
of this title that is inconsistent with the refusal; or
(3) by destroying or canceling the record evidencing the refusal,
or the portion of the record used to make the refusal, with the intent to revoke the refusal.
(d) Except as otherwise provided in subsection 5250h(h) of this title,
in the absence of an express, contrary indication by the individual set forth
in the refusal, an individual's unrevoked refusal to make an anatomical gift
of the individual's body or part bars all other persons from making an anatomical gift
of the individual's body or part. (Added 2009, No. 119 (Adj. Sess.), § 1.)

REMEMBER, DOCTORS COMPLAIN THAT VERMONT MEDICAID
DOESN'T PAY THEM ENOUGH - HOW MUCH MONEY CAN THEY

I hope that sane, informed

I hope that sane, informed people will realize that this proposed law doesn't change how organs are harvested or transplanted into viable patients. It's purpose is to possibly alleviate the tragedy of thousands of people on transplant lists dying due to the shortage of healthy donor organs. No organs are going to be taken and sold to the highest bidder and no one will be hurried along to their deaths to get their organs. The procedure will be done in the same respectful and professional manner that has always been a part of organ donations. One person's healthy organs can save up to 11 lives. That's a pretty remarkable gift.
I'd also like to suggest that the commenter read up on how surgeries are actually performed for transgender people who decide on genital surgery. Nobody's random penis is being lopped off and "sewn onto a woman's groin". That's not how it's done.
As always in Ms. Ericsson's posts- a little education goes a long way.
I would urge the people of Vermont to see this new law as what it is: an opportunity to save thousands of lives.

Presumed consent is a significant change to the law

If I am understanding this correctly, "presumed" consent has passed and is now the law in Vermont. Your organs can be harvested unless the medical staff present at your death knows that you have properly filled out and filed specific document opting out.

Other than CrisEricson's alerts on ibrattleboro, I have seen nothing else about this. With this change in law slipping by almost unnoticed, how many Vermonters realize that organ donation is not "opt-out" rather than "opt-in?"

When you are admitted for hospital care, will you be told about this and given the forms needed to opt out? Upon being admitted to a hospital, a patient is likely to be pre-occupied with their medical problems and not likely to realize that they must take specific action in order to opt-out of automatic organ donation. It hardly makes sense to claim that nothing essential has changed.

Despite her over-the-top style, CrisEricson has let us know about something very important: something which seems to have happened without being adequately reported. Why have our elected official not made an effort to inform us? How come I have heard nothing about this on VPR or other news outlets?

Breathe easy

Presumed consent, in fact, has not passed in the Vermont, nor, I think in any state. There is a bill, H.106, in the state assembly that may or may not come out of committee January 2018. If it comes to floor then that would necessitate testimony, particularly from the VT Ethics Network and other sources.

According to the Home Dialysis United, as of June 2016, “Similar presumed consent bills have been proposed throughout the nation—New York in 2010, Virginia in 2014, and Vermont in 2015. All have met defeat.”

It is true that the issue of “ethics” will play largely in the formation and enactment of a possible future Vermont presumed consent law.

However, the scare tactics and “over-the-top style” of CrisEricson are a one-sided attempt to demonize the process. Moreover, for a cogent discussion on presumed consent, there are better and more efficient ways to be informed than one led by CrisEricson.

Twenty-four countries in the European Union have some form of presumed consent that is instrumental in seeing life saving high yield donor rates without of all the American-style rigmarole...all without the nefarious and fearmongering of selling human body parts

My interpretation of the existing Bill is that you have
to file documents with witnesses to opt out,
rather than be automatically opted-out.
I'm not a lawyer, I'm just a human being
reading what I find on the internet.

How many Vermonters don't know half,
or even most of the laws in Vermont?

I told H. Brooke Paige today that I will not
have surgery on a hole in my face because
I am concerned about becoming an unwilling
organ donor. I said that instead of being
known for my big hats on t.v., I'll be known
for a hole in my face in 2018.

I thought the surgeon would just stitch the hole up,
but he claims I have to be put to sleep and operated on.
The problem is that a previous surgeon, last December 2016,
operated and did not seal up the incision with a clamp
or stitches, and it never healed shut.

Sorry, I'm so touchy about this subject!
The hospital scheduling wanted me to pick
Nov 3rd or Dec.1 for a surgery date, and
handed me a brochure telling me to bring a
copy of my WILL.
I couldn't run out of there fast enough!

Commissioner shall provide a form which, upon the licensee’s execution of the form,
shall serve as a document of refusal to make an anatomical gift under 18 V.S.A.
chapter 110 § 5254. An indicator shall be placed on the license of any person
who has executed an anatomical gift refusal form in accordance with this section.
Sec. 3. REPEAL
18 V.S.A. chapter 110 (Revised Uniform Anatomical Gift Act) is repealed.
Sec. 4. EFFECTIVE DATE
This act shall take effect on January 1, 2018.

Any hospital worth it's

Any hospital worth it's accreditation will ask you to bring in a copy of your living will/ end of life statements so they have them on file. That's the only way they would know what you wanted to be done or not done in case of a medical emergency. It is to guarantee that you received the lifesaving measures that you want or to not administer those measures if you don't want them.
They would never ask you for your will- it has nothing to do with your medical choices.
Not everything is a conspiracy. Some things are actually done for the good of patients.
Maybe don't believe every word you read on the internet. It's a cesspool of misinformation.

I hope I helped to ease your fears on this touchy subject for you. Perhaps you should have the facial skin repair done while you can. I guess all else will have to wait until we see what the state assembly comes up with as presumed consent is debated and thrashed about across the aisles in the 2018 session.

the doctor who is promoting the bill could profit from it!

I looked up the state representative, George W. Till,
who is promoting the bill, and he is a medical doctor raised in Pittsburgh, PA, and he could profit enormously if "presumed consent" ever became the law.

Did this medical doctor,George W. Till,
come to Vermont to take advantage of us, to use us, to profit from us? Think about it, he's a medical doctor with all kinds of connections, and if "Presumed Consent" became the law in Vermont, then he could start a new organ bank and a new organ transplant facility, and we would be the hamburger in his processing plant. Free hamburger! Our bodies would belong to the State of Vermont who would "donate" them to George W. Till because he could charge huge "surgery" and "body storage" etc. fees to customers who would come from around the world to Vermont. And what would be the motive of the State of Vermont to give him our bodies? Taxes! They could charge taxes on the fees for storing the "donated" organs etc. And what else? Campaign contributions! Any other State Representative or State Senator who votes for Dr. George W. Till M.D.'s proposed bill might get huge campaign donations from him because he will become one of the richest men in the world selling his services as a surgeon, repeatedly seriously and willfully and intentionally profiting from our "donated" organs!

Good Lord! Is there a federal law this guy can be charged in criminal conspiracy with, along with others in the medical profession for cannabilism and contract fraud because it is clearly contract fraud when there is no meeting of the minds, when you are taking personal property without informed consent. (Now I will go look up all the federal criminal laws I think this doctor is conspiring to violate.)

As I discussed somewhat with H.Brooke Paige, who has a lawsuit regarding new school laws, I see this also as an issue of freedom of choice and freedom of religion.

Think about it, some people do believe in Heaven and Purgatory, and if part of your body is alive in someone else, you can't completely die, your soul is torn in two, and you live in purgatory until the organ transplant recipient dies, but, if the organ transplant recipient dies, for example, in a car accident, and the organ is still perfectly good, it could be transplanted to a second person; and then your sould, torn in two still, remains in purgatory.
