I will not get into the fact that we have a constitutional right to travel absent a license as long as we are not doing commerce. This article is to help you understand the deeper agenda. Remember the basis of creating a Real ID was to follow the recommendations of the 9/11 commission report, regardless of whether the 9/11 commission report provides an accurate assessment of what happened on 9/11, it does not in any way recommend that American citizens be subjected to criminal suspicion, instead it only mentions foreign terrorist concerns.

REAL ID: Constitutional Objections and Impacts on Individual Liberty
- CREATED UNDER FALSE PRETENSES – REAL ID was introduced under the pretext of implementing a recommendation from the 9/11 Commission to prevent foreign terrorist entry. Nowhere in the 9/11 Commission Report is there a recommendation, authorization, or suggestion to treat the American people as suspects or to implement sweeping domestic surveillance measures.
- FEDERAL INFRINGEMENT of the 4th Amendment – REAL ID is effectively a federalized national identification system, enabling warrantless surveillance and tracking of the American people without probable cause or individual suspicion.
- NONCONSTITUTIONAL OVERREACH – REAL ID represents a direct usurpation of state sovereignty and a violation of individual privacy rights. There is no enumerated authority in the U.S. Constitution granting the federal government power to require a national identification document for travel.
- MANUFACTURED “OFFICIAL PURPOSE” LANGUAGE – The term “official purpose” is vaguely defined to include access to federal facilities, boarding aircraft, nuclear sites, and any other use the Secretary of Homeland Security may determine, effectively granting unlimited discretionary power to the head of an unelected agency.
- DELIBERATE PUBLIC DECEPTION – Public messaging has falsely claimed that “you can’t fly without a REAL ID.” DHS’s own 2008 rule states that individuals may still travel or access federal buildings with alternative identification.
- COLLUSION AT THE STATE LEVEL – Despite over half of U.S. states either passing laws or resolutions opposing REAL ID, unelected state DMVs in the remaining states quietly implemented it in collusion with DHS, incentivized financially through federal funding.
- UNILATERAL FEDERAL CONTROL – The Secretary of Homeland Security has claimed discretionary authority to redefine the purpose and use of REAL ID without Congressional approval, as per DHS statements in the 2008 rule.
- DIGITAL TRACKING EXPANSION – The American Association of Motor Vehicle Administrators (AAMVA) testified in December 2023 revealing plans to integrate REAL ID into mobile phones, granting real-time data access and warrantless surveillance by federal agencies.
- TSA PENALTY THREATS – Under TSA’s final rule (January 14, 2025), enforcement began May 7, 2025, with “progressive” penalties. A “three-strikes” system has been unlawfully imposed on travelers without REAL ID or DHS-approved documentation, through May 2027.
- IMPAIRMENT OF PRIVATE CONTRACTS– REAL ID and TSA enforcement insert the federal government between private airlines and individual travelers. This interference violates the constitutional right to contract, as guaranteed by the Contracts Clause (Article I, Section 10), by conditioning private travel on submission to federal ID mandates and biometric compliance. In contract law, third parties cannot lawfully impose terms or acquire enforcement rights simply because they are affiliated with one of the contracting parties. Contracts bind only those who are explicitly party to the agreement. When a traveler purchases a ticket, they enter a private contract with the airline—not with the federal government. Any regulatory contract the federal government may hold with the airline does not give it legal authority to impose conditions such as identification mandates or bodily searches on the traveler unless the traveler has freely consented.
Moreover, under Article I, Section 10, Clause 1 of the U.S. Constitution, “No State shall enter into any Treaty, Alliance, or Confederation…” By partnering with the Department of Homeland Security—a federal executive agency not party to the compact of the states—state governments are effectively entering into unauthorized alliances. This further demonstrates the nonconstitutional nature of REAL ID enforcement at the state level.
- STATE GOVERNOR COMPLICITY – State officials enforcing REAL ID violate Article I, Section 10, Clause 1 by forming unauthorized alliances with a federal agency (DHS) and a sub agency (TSA) when neither holds constitutional authority to impose mandates upon free citizens of the states.
Conclusion: The Real ID lays the groundwork for a federal surveillance infrastructure under the guise of safety. It is not just a security policy—it is a nonconstitutional system of centralized control. It treats law abiding American citizens as criminals without due process, violating the 5th Amendment. It violates the 4th Amendment, and the Contract Clause, infringes upon states’ rights, and does not reflect the 9/11 commissions’ recommendations.
