Brattleboro Selectboard Agenda and Notes – February 4, 2014

The Brattleboro Selectbaord will see three plans and proposed budget for new Police Fire facilities during their Tuesday meeting at the Municipal Center. 

There will be a discussion of the FY13 audit, they will set a special meeting to discuss the Utility budget and rates, and will hear about adding late fees and fining businsses for not having a Brattleboro  business license.

Four new Police recruits will be sworn in, and the board will contemplate a hiring pause for the Town.

The Brattleboro Selectboard will meet on Tuesday, February 4, 2014 in the Selectboard meeting room at the Municipal Center.  It is anticipated that the Board will enter into executive session at 5:30pm to discuss personnel and litigation matters, and reconvene the regular meeting at 6:15pm.

SUBJECT: Administrative Report

The following will summarize the proposed motions for those items on the Agenda for the Tuesday, February 4, 2014 Selectboard Meeting. It is anticipated that the Board will meet in executive session beginning at 5:30pm to discuss a personnel matter and potential litigation, and the regular meeting will begin at 6:15pm.

7. LIQUOR COMMISSIONERS

A. Approve Second Class Liquor & Tobacco Licenses – Martin’s Foods of South Burlington, LLC d/b/a Hannaford Supermarket. The Board is asked to approve second class liquor and tobacco licenses for Martin’s Foods of South Burlington, LLC d/b/a Hannaford Supermarket. The need for this license arises from the company’s recent transition from a corporation to an LLC. There are no outstanding fees or taxes, and Martin’s Foods of South Burlington, LLC possesses a current business license.

POTENTIAL MOTION: TO APPROVE SECOND CLASS LIQUOR AND TOBACCO LICENSES FOR MARTIN’S FOODS OF SOUTH BURLINGTON LLC D/B/A HANNAFORD SUPERMARKET, LOCATED AT 896 PUTNEY ROAD.

B. Approve First Class Liquor License – Dorothy Pond, d/b/a Northside Subs & More. The Board is asked to approve a first class liquor license for Dorothy Pond, d/b/a Northside Subs & More. There are no outstanding fees or taxes, and Ms. Pond possesses a current business license. The application has been reviewed and approved by Brattleboro Police, and the owner is currently working with Brattleboro Fire to obtain a certificate of occupancy.

POTENTIAL MOTION: TO APPROVE A FIRST CLASS LIQUOR LICENSE FOR DOROTHY POND, D/B/A NORTHSIDE SUBS & MORE, LOCATED AT 648 PUTNEY ROAD.

A. Swearing in Ceremony – Four Police Recruits. Town Clerk Annette Cappy will swear in four new police officers. The process is routine for all new officers, but it may be the first time at a Selectboard meeting.

POTENTIAL MOTION: NONE

B. Police-Fire Facilities Project – Update. Project Manager Steve Horton and Architect Ray Giolitto will be present to walk the Board through the initial plans for the Police-Fire Facilities project. Each of the three plans has been reviewed and accepted substantially as presented by the oversight committee. In addition to examining the plans, the Board will be presented with the most up to date budget outlook for the project. A limited selection of design plans are included in this packet.

C. 2014 Certificate of Highway Mileage – Approval, Department of Public Works. The Board is asked approve the annual certificate of highway mileage for submission to the Vermont Department of Transportation. Public Works Director Steve Barrett will be present to discuss how the mileage is used by the State to determine the level of financial support Brattleboro receives for class two roadways.

POTENTIAL MOTION: TO APPROVE THE 2014 CERTIFICATE OF HIGHWAY MILEAGE AS PRESENTED.

D. Award Bid – WWTP Outfall Pipe Project, Department of Public Works. There are two remaining FEMA funded public infrastructure projects from Tropical Strom Irene. The outfall pipe is the very last section of the waste water treatment plant; the discharge pipe that leads into the Connecticut River. The pipe was found to be damaged after the storm, but was not initially considered to be storm damage by FEMA. A lengthy appeal process led to a reversal of this position; however the initial estimate to complete the repair is inadequate to cover the lowest bid. A scope change has been submitted by the State to FEMA and may be approved. However, any delay on our part, will signal to FEMA that the project is not necessary. This is the case even as our discharge permits are based on a specific and accepted design. If the scope change is not approved by FEMA, the uncovered balance of the project would reduce the fund balance in the Utility Fund.

POTENTIAL MOTION: TO AWARD A CONTRACT TO KINGSBURY COMPANIES OF WAITSFIELD, VERMONT, IN THE AMOUNT OF $152,200, TO COMPLETE REPAIRS TO THE BRATTLEBORO OUTFALL PIPE.

E. Grant Application – Communications Equipment Grant, Brattleboro Fire Department. The Board is asked to approve a grant application in the amount of $72,232 to the Vermont Division of Emergency Management and Homeland Security (VDEMHS) for support to replace hand-held radios and pagers, and to acquire a mayday decoder. As the Board may recall, replacing these radios was a component of a recent BFD grant application to FEMA. The difference between these two granting sources is that the VDEMHS grant program does not require a match. As a result, the State grant would be preferable to the federal grant.

POTENTIAL MOTION: TO APPROVE A GRANT APPLICATION TO THE VERMONT DIVISION OF EMERGENCY MANAGEMENT AND HOMELAND SECURITY IN THE AMOUNT OF $72,232 TO REPLACE ALL PORTABLE RADIOS AND PAGERS, AND TO PURCHASE A MAYDAY DECODER.

F. HSGP Law Enforcement Terrorism Prevention Grant – Update. The Town of Brattleboro has received preliminary notification of a future award of $95,970 for portable and mobile radios. The application included a request for a voting repeater system that would have supported placement of Brattleboro Police Department’s radio equipment alongside Brattleboro Fire Department’s equipment at the Brattleboro Memorial Hospital. With this news, Brattleboro will temporarily place its equipment atop Harris Hill, until such time as the remaining funds can be raised to acquire the voting repeater system, and complete the transition to the hospital.

G. FY13 Financial Audit – Discussion, Finance Department. Finance Director John O’Connor will be present to discuss the FY13 audit.

POTENTIAL MOTION: NONE

H. Business License Fines – Assessor’s Office. The Board is asked to review and approve the fees for late filing as well as impose a penalty, as outlined in Chapter 11 of the Town Ordinances, for businesses that have failed to apply for a business license on time and continue to operate their business for a period of time in excess of 30 days after the filing deadline. Municipal Assessor Russell Rice will be present to discuss the department’s collection efforts. The business license process is critical to support Brattleboro Emergency Services Police and Fire, to collect accurate and up to date contact and other information about businesses in Brattleboro. Properly filing for a business license provides the holder of that license up to $5,000 in relief from Business Personal Property tax.

POTENTIAL MOTION: TO ACCEPT THE 2014 BUSINESS LICENSE FINE LIST AS PRESENTED AND TO DIRECT THE ASSESSOR’S OFFICE TO IMPOSE THE LATE FEE OF $25 AND A SEPARATE PENALTY OF $100 FOR OPERATING A BUSINESS WITHOUT A LICENSE.

J. Committee Appointments – Tree Advisory Committee, Senior Solutions Board. The Board is asked to appoint committee members to the Tree Advisory Committee and the Senior Solutions Board. The Tree Advisory Committee has two vacant seats with terms ending in June, 2014 and June, 2016. The Senior Solutions Board has one vacant seat with a term ending June, 2014.

POTENTIAL MOTION: TO APPOINT ROSAMOND BLAKE TO THE TREE ADVISORY COMMITTEE FOR A THREE-YEAR UNEXPIRED TERM ENDING JUNE 30, 2016, AND SUMMER BURCH TO THE SENIOR SOLUTIONS BOARD FOR A ONE-YEAR UNEXPIRED TERM ENDING ON JUNE 30, 2014.

K. Schedule Informational Town Meeting and Caucuses – Wednesday, March, 12, 6:00pm, Academy School. The Board is asked to schedule the annual Informational Town Meeting and caucuses. The meeting is traditionally held on Wednesday during the week preceding Representative Town Meeting. Town Clerk Annette Cappy reports that the Academy School is available on Wednesday, March 12, 2014, at 6:00pm.
