Brattleboro Selectboard Meeting – Agenda and Notes February 15, 2022

At their next regular meeting the Brattleboro Selectboard will consider changing the rules about downtown snow removal, possibly ending the practice of removing snow for building owners and charging them after for the work.

The board will revisit the mask mandate, take care of some grants, appoint some people, and consider use of ARPA funds to replenish the parking fund. You can, as always, bring up pther items not on the agenda during public participation.

The following will summarize the proposed motions for the Selectboard meeting on Tuesday, February 15, 2022. The Board will meet in executive session at 5:15pm to discuss the appointment or employment or evaluation of a public officer or employee. The Board will reconvene the business meeting at 6:15pm in the Second Floor Meeting Room at the Central Fire Station at 103 Elliot Street and on Zoom. After the business part of the meeting has concluded, the Selectboard will reconvene in executive session to discuss the negotiating or securing of real estate purchase or lease options. The Board will then reconvene into public session solely for the purpose of adjourning. No action will be taken in executive session.

The public is strongly encouraged to attend and participate on Zoom.

People who choose to attend the meeting in-person will be required to wear a face covering and adhere to social distancing.

A. Finance Report – Monthly Report

The Monthly Financial Report through December is included in the Selectboard’s backup materials for this meeting, along with a summary memorandum dated February 7, 2022, from Accountant Kim Ellison.

POTENTIAL MOTION: TO ACCEPT THE MONTHLY FINANCIAL REPORT AS PRESENTED.

B. Rule Requiring Face Coverings in Indoor Public Spaces – Continue in Full Effect 

As required by the Rule Requiring Face Coverings Resolution, the Board will consider whether to extend, modify or repeal the resolution. As required by State legislation that enabled municipal governments to adopt local face covering rules, the Board must pass a motion extending the resolution for another 30 days. 

POTENTIAL MOTION: TO EXTEND THE RULE REQUIRING FACE COVERINGS FOR THIRTY DAYS. 

C. Red Clover Commons II Grant – Close Out Public Hearing

In a memorandum dated February 8, 2022, Assistant Town Manager, Patrick Moreland, discussed the Brattleboro Housing Authority’s Red Clover Common II project, which included a $300,000 Community Development Block Grant and $50,000 grant from the Town’s Revolving Loan Fund. The Board is asked to conduct a close out public hearing. 

POTENTIAL MOTION: NO ACTION IS REQUIRED 

D. BHA COVID Grant – Close Out Public Hearing

In a memorandum dated February 8, 2022, Assistant Town Manager Patrick Moreland discusses the Brattleboro Housing Authority COVID Reimbursement Grant which was used to reimburse BHA for Covid related expenses. The Board is asked to conduct a close out public hearing. 

POTENTIAL MOTION: NO ACTION IS REQUIRED 

E. Board of Civil Authority – Election Appointments

In a memorandum dated February 8, 2022, Town Clerk Hilary Francis explains that as per 17V/S/A/ 2143, the Brattleboro Republican Town Committee is nominating Richard Kenyon, Richard Morton and Aaron Smith to the Board of Civil Authority. 

POTENTIAL MOTION: TO APPOINT RICHARD KENYON, RICHARD MORTON AND AARON SMITH TO THE BOARD OF CIVIL AUTHORITY FOR ELECTION PURPOSES ONLY. 

F. Downtown Sidewalk Snow Removal – First Reading of Proposed Ordinance Amendment 

In a memorandum dated February 8, 2022, Town Manager Yoshi Manale recommends that the Selectboard amend the Town Code of Ordinances in Chapter 14, Article 1 Section 14-5 and Chapter 14, Article 1, Section 14-8, regarding the removal of snow and ice from downtown sidewalks, due to increased non- compliance. The proposed changes would eliminate the Town’s past practice of having the work performed and billing the property owner and replacing it with a higher fine for non-compliance. 

NO ACTION REQUIRED AT THIS TIME. 

G. Parking Revenue Losses – Replenish with ARPA SLFRF

In a memorandum dated February 7, 2022, Assistant Town Manager Patrick Moreland discusses using funds from the American Rescue Plan Act (ARPA) and State and Local Fiscal Recover Funds (SLFRF) to replenish the Town’s Parking Fund. 

POTENTIAL MOTION: TO ACCEPT THE ONE-TIME STANDARD ALLOWANCE OF UP TO $10 MILLION FOR THE PURPOSE OF CALCULATING LOST REVENUE AS PROVIDED BY THE US DEPARTMENT OF TREASURY FOR THE CORONAVIRUS STATE AND LOCAL FISCAL RECOVERY FUNDS AND TO USE $555,225 IN SLFRF FOR THE PROVISION OF GOVERNMENTAL SERVICES AND TO REPLENISH LOST REVENUE IN THE PARKING FUND AND TO USE $90,000 IN SLFRF FOR THE PROVISION OF GOVERNMENTAL SERVICES AND TO REPLENISH LOST REVENUE IN THE GENERAL FUND. 

H. Representative Town Meeting – Assign Motions

The Board is asked to assign motions for the articles to be considered at the upcoming Representative Town Meeting.
