Brattleboro Selectboard Meeting Agenda and Notes – February 21, 2023

The Brattleboro Selectboard will do a number of routine items at their next regular meeting – renew liquor and tobacco licenses, get updates on EMS and finances, grant and easement for the new train station project, discuss ARPA, and review RTM child care options.

The board will also take up an appeal to a health order for 16 Washington Street and adopt a revised tree ordinance. You can bring up other items not on the agenda during public participation.

The Brattleboro Selectboard will meet on Tuesday, February 21, 2023 at 6:15pm in the Selectboard Meeting Room at the Brattleboro Municipal Center at 230 Main Street. The public may also participate in the meeting over Zoom. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.”  ASL interpreters will be available for deaf and hard-of-hearing community members.

7. CONSENT AGENDA (6:40pm)

A. 2023 Liquor License, Tobacco License, Outside Consumption Permits and Tobacco Substitute Endorsements Annual Renewals

The Board is asked to conditionally approve annual renewals of Liquor Licenses, Outside Consumption Permits, Tobacco Licenses and Tobacco Substitute Endorsements as set forth in a memorandum dated February 9, 2023, from Town Clerk Hilary Francis. By approving the consent agenda, the Board will approve the renewal of Liquor Licenses, Outside Consumption Permits, Tobacco Licenses and Tobacco Substitute Endorsements for the entities presented, with each individual license renewal contingent upon the licensee’s providing the Town with the necessary documentation, not having any outstanding debt to the town, having a valid current business license, and complying with any Police and Fire Department requirements.

8. HEALTH COMMISSIONERS (6:45pm)

A. Emergency Health Order Appeal – 16 Washington Street

In a memorandum dated February 10, 2023 Assistant Fire Chief Charles Keir discusses an Emergency Health Order for the property of 16 Washington Street, that was issued on February 8, 2023. This property is associated with accessory units (recreational vehicles). The Selectboard is asked to convene as the Local Board of Health during the February 21, 2023 Selectboard Meeting. Kurt Daims, the property owner, has been notified of their right to appeal the Health Order during the meeting and has also been given all the evidence relating to this emergency health order. All associated reports and evidence are included in the Board’s backup materials.

POTENTIAL MOTION: TO ISSUE THE HEALTH ORDER AS PROPOSED BY THE HEALTH OFFICER REQUIRING COMPLIANCE WITHIN 5 DAYS OF THIS ORDER.

9. UNFINISHED BUSINESS (7:15pm)

A. Regulation of Public Tree Ordinance – Second Reading and Possible Adoption

In a memorandum dated February 10, 2023, Superintendent of Public Works Peter Lynch discuses he changes that were made as a result of the first reading of this ordinance change. The Board is asked to conduct a second reading and possibly adopt the Regulation of Public Tree Ordinance.

POTENTIAL MOTION: TO ACCEPT THE REVISIONS PROPOSED BY THE TREE ADVISORY BOARD TO THE CODE OF ORDINANCE CHAPTER 14 (STREETS AND SIDEWALKS) ARTICLE V. (REGULATION OF PUBLIC TREES).

10. NEW BUSINESS

A. EMS Update (7:25)

In a memorandum dated February 10, 2023 Assistant Fire Chief Charles Keir provides an update on EMS services for the month of January.

POTENTIAL MOTION: NO MOTION REQUIRED ON THIS ITEM.

B. Monthly Financial Report (7:35)

In a memorandum dated February 6, 2023, Finance Director Kimberly Frost discusses the monthly Financial Report for January 2023.

POTENTIAL MOTION: TO ACCEPT THE FINANCIAL REPORT, AS PRESENTED.

C. Amtrak Easement for Station (7:45)

In a memorandum dated February 12, 2023, Assistant Town Manager Patrick Moreland discusses Amtrak’s plans for a new ADA compliant train station in Town; Depot Street improvements the Town has nearly completed for this project; and next steps. Officials from Amtrak will be in Town on February 21, 2023 and would like to secure an easement for the right to construct a new passenger rail station. Town staff and the Town Attorney have developed an easement agreement and the Board is asked to authorize the Town Manger to execute the agreement and allow the project to proceed.

POTENTIAL MOTION: TO AUTHORIZE THE TOWN MANAGER TO EXECUTE AN EASEMENT AGREEMENT WITH AMTRAK (NATIONAL RAILROAD PASSENGER CORPORATION) FOR USE OF A PORTION OF THE DEPOT STREET PARKING LOT FOR A NEW PASSENGER RAIL STATION.

D. ARPA Allocation Process – Discussion (8:35)

In a memorandum dated February 15, 2023, Town Manager John Potter discusses the Selectboard’s previous history regarding the Town’s $3,401,701 allocation of ARPA funds, including the $645,224 that has already been allocated to replenish the Town’s Parking Fund. He also discusses two main goals for the ARPA process going forward: 1. To define an approach that is transparent and accessible to the public. 2. To include a community engagement component. Potter recommends a phased approach to the ARPA allocation process going forward and briefly outlines the six-phases suggested.

E. RTM Childcare – Update (9:05)

In a memorandum dated February 16, 2023 Executive Assistant Jessica Sticklor discusses background information on the Town’s decision to provide childcare at Representative Town Meeting, as well as the steps Town staff has taken to secure childcare, and recommendations for next steps.
