Brattleboro Selectboard Special Meeting Agenda April 25, 2024

The Brattleboro Selectboard will hold a special meeting on Thursday, April 25, 2024 at 6:15pm in the Selectboard Meeting Room at the Brattleboro Municipal Center (230 Main Street, Room 212) and over Zoom. Prior to the meeting at 5:30pm, the Board will convene and is expected to enter immediately into executive session to discuss contracts and real estate negotiations. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.”  ASL interpreters will be available for deaf and hard-of-hearing community members. The backup materials for this meeting will be available on the town Website Brattleboro.gov/Selectboard by the end of today.

Please note that this meeting will convene on Thursday, instead of the usual Tuesday, evening for this meeting only.

The Board is asked to conditionally approve annual renewals of Liquor Licenses,
Outside Consumption Permits, Tobacco Licenses and Tobacco Substitute Endorsements
as set forth in a memorandum dated April 23, 2024 from Town Clerk Hilary Francis. By
approving the consent agenda, the Board will approve the renewal of Liquor Licenses,
Outside Consumption Permits, Tobacco Licenses and Tobacco Substitute Endorsements
for the entities presented, with each individual license renewal contingent upon the
licensee’s providing the Town with the necessary documentation, not having any
outstanding debt to the Town, having a valid current business license, and complying with
any Police and Fire Department requirements. By approving the Consent Agenda, the
Board will conditionally approve the annual renewals of Liquor Licenses, Outside
Consumption Permits, Tobacco Licenses and Tobacco Substitute Endorsements set forth
in a memorandum dated April 23, 2024 from Town Clerk Hilary Francis.

In a memorandum dated April 10, 2024 Department of Public Works Director Dan Tyler
encloses the VTrans Annual Financial Plan, which is required to be submitted to VTrans 60
days after the adoption of a municipal budget.

In a memorandum dated April 10, 2024, Public Works Director Dan Tyler encloses the
VTrans Annual Certificate of Compliance which is required to ensure eligibility for possible
Class II roadway and structure funds.

In a memorandum dated April 23, 2024 Town Clerk Hilary Francis discusses the Annual
Entertainment License application for Hooker-Dunham Theater and Gallery located at 139
Main Street. Town staff have reviewed and approved this license. By approving the
Consent Agenda, the Board will approve an Annual Entertainment License for the Hooker-
Dunham Theater and Gallery, located at 139 Main Street.

In a memorandum dated April 23, 2024 Town Clerk Hilary Francis discusses the Annual
Entertainment License application for Vermont Earth Works, DBA: WVEW-LP located 46
Harmony Place. Town staff have reviewed and approved this license. By approving the
Consent Agenda, the Board will approve an Annual Entertainment License for Vermont
Earth Works, DBA: WVEW-LP, located 46 Harmony Place.

In a memorandum dated April 23, 2024 Town Clerk Hilary Francis discusses the Annual
Entertainment License application for the New England Center for Circus Arts, DBA:
NECCA located at 10 Town Crier Drive. Town staff have reviewed and approved this
license. By approving the Consent Agenda, the Board will approve an Annual
Entertainment License for the New England Center for Circus Arts, DBA: NECCA, located
at 10 Town Crier Drive.

In a memorandum dated April 23, 2024 Town Clerk Hilary Francis discusses the First and
Third Class Liquor Licenses and Annual Entertainment License application for PLATED
Restaurant and Bar, located at 136 Main Street. Town staff have reviewed and approved
these licenses. By approving the Consent Agenda, the Board will approve the First and
Third Class Liquor Licenses and the Annual Entertainment License applications for
PLATED Restaurant and Bar, located at 136 Main Street.

Southeastern Vermont Community Action, Inc. (SEVCA) asks the Board to appoint John
Couleur and Kevin Kennedy, both Brattleboro residents, as representatives to the SEVCA
Board in the Public Sector. By approving the Consent Agenda, the Board will appoint John
Couleur and Kevin Kennedy to the Southeastern Vermont Community Action, Inc (SEVCA)
Board in the Public Sector.

8. OLD BUSINESS

A. Selectboard Housekeeping – Rules of Procedure aka Rules of Conduct (6:35 PM)
In a memorandum dated April 19, 2024 Town Manager John Potter discusses the updated
Selectboard Rules of Procedure as well as the changes discussed at the April 2, 2024
Selectboard meeting. The Board is asked to consider, and possibly adopt, these rules.

POTENTIAL MOTION: TO ADOPT THE 2024 BRATTLEBORO SELECTBOARD’S
RULES OF PROCEDURE, AS PRESENTED [OR AMENDED].

9. NEW BUSINESS (6:35 PM)

A. Local Emergency Management Plan for 2024 (6:50 PM)

Vermont Emergency Management requires municipalities to annually submit a Local
Emergency Management Plan (LEMP). The Board is asked to adopt the 2024 Brattleboro
LEMP and to authorize the Town Manager to certify that the Town’s LEMP has been duly
adopted by the Board. A copy of the Town’s 2024 LEMP is included in the Board’s backup
materials, along with a memorandum dated April 10, 2024 from Fire Chief Leonard Howard
III that summarizes this year’s LEMP update.

POTENTIAL MOTION: TO ADOPT THE 2024 BRATTLEBORO LOCAL EMERGENCY
MANAGEMENT PLAN (LEMP) FOR 2024 AND TO AUTHORIZE THE TOWN MANAGER
TO CERTIFY THAT THE TOWN’S LEMP HAS BEEN DULY ADOPTED BY THE BOARD.

B. Quarterly Fire Department Report (7:00 PM)

In a memorandum dated April 2, 2024 Fire Chief Leonard Howard III and Assistant Fire
Chief Charles Keir present the Fire/EMS Report for March.

POTENTIAL MOTION: TO ACCEPT THE FIRE/EMS REPORT, AS PRESENTED.

C. EMS Policies (Response Standard) (7:15 PM)

In a memorandum dated April 3, 2024 Fire Chief Leonard Howard III and Assistant Fire
Chief Charles Keir discuss the Fire Department’s proposed Response Time Policy. The
Board is asked to discuss, and possibly adopt, this policy.

POTENTIAL MOTION: TO ADOPT THE FIRE DEPARTMENT’S PROPOSED RESPONSE
TIME POLICY, AS PRESENTED [OR AMENDED].

D. Quarterly Financial Report (FY24, through Q3) (7:35 PM)

In a memorandum dated April 15, 2024, Finance Director Kimberly Frost discusses the
Quarterly Financial Report through Quarter 3.

E. FY25 Budget Process After Action Review (7:55 PM)

In a memorandum dated April 18, 2024 Assistant Town Manager Patrick Moreland
discusses the budget development process as well as the budget review process, staff’s
observations on this process, and potential improvements. The Board is asked to provide
feedback on this matter.
