The Brattleboro Selectboard will meet on Tuesday, September 6, 2022 at 5:30pm and is expected to enter immediately into executive session to discuss contracts. The Selectboard will reconvene the business part of the meeting at 6:15pm in the Selectboard Meeting Room at the Brattleboro Municipal Center at 230 Main Street. The public may also participate in the meeting over Zoom. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.”  ASL interpreters will be available for deaf and hard-of-hearing community members.

7. CONSENT AGENDA

A. Vermont Department of Libraries $571.35 Courier Grant – Authorize Application

B. VLCT Annual Business Meeting – Appoint Delegate

In a memorandum dated September 1, 2022 Library Director Starr LaTronica requests that the Board authorize the application of a $571.35 Courier Grant from the Vermont Department of Libraries to pay for postage for interlibrary loan services.

In a memorandum dated September 1, 2022, Interim Town Manager Patrick Moreland informed the Selectboard that the Vermont League of Cities and Towns’ (VLCT’s) annual Town Fair (VLCT’s annual conference, including meetings and educational workshops) will be held on October 6th and 7th this year. As part of the Town Fair, VLCT’s annual business meeting will be held on October 6, 2022. At the annual business meeting, each member municipality is entitled to one vote on every matter that is acted upon. VLCT rules require that the Selectboard appoint a voting delegate to cast Brattleboro’s vote. Moreland states that since he will already be attending the PACIF Board of Director’s meeting, he recommends appointing himself as the delegate. By approving this item on the consent agenda, the Board will appoint Patrick Moreland as the Town’s voting delegate for this meeting.

POTENTIAL MOTION: TO ACCEPT THE CONSENT AGENDA, AS PRESENTED.

8. NEW BUSINESS

A. VTrans Bike and Pedestrian Grant – Accept and Appropriate

In a memorandum dated September 1, 2022, Planning Director Sue Fillion requests that the Board accept and appropriate a grant of $18,000 from the Vermont Agency of Transportation for the Western Avenue Bike Lanes Project Phase 1. This grant requires a 50% match. The FY23 budget included a $12,000 transfer from the General Fund to the Capital Fund in anticipation of a grant for this project. This project includes constructing 5 feet of bicycle lanes on the northern and southern sides of Wester Avenue from Green Street to Allerton Avenue. It will also include new crosswalks at Speno Court and Green Street, bike lane signage and a Rapid Rectangular Flashing Beacon at Allerton Avenue.

POSSIBLE MOTION: TO ACCEPT AND APPROPRIATE A GRANT OF $18,000 FROM THE VERMONT AGENCY OF TRANSPORTATION FOR WESTERN AVENUE BIKE LANES PHASE 1.

B. Windham and Windsor Housing Trust Application for a Scattered Site Grant – Public Hearing and Authorize Application

In a memorandum dated August 30, 2022, Interim Town Manager Patrick Moreland discusses the background of the Scattered Site Program, the VCDP Request and project demographics. The Selectboard is asked to conduct a public hearing and adopt the resolution authorizing the submission of a grant application for a Vermont Community Development Program Scattered Site Grant in the amount of $525,000 to support Windham and Windsor Housing Trust to deliver a Home Repair Program, Counseling Advocacy, and First Time home Buyer Services.

POSSIBLE MOTION: ADOPT THE RESOLUTION AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION FOR A VERMONT COMMUNITY DEVELOPMENT PROGRAM SCATTERED SITE GRANT IN THE AMOUNT OF $525,000 TO SUPPORT WINDHAM AND WINDSOR HOUSING TRUST TO DELIVER A HOME REPAIR PROGRAM, COUNSELING ADVOCACY, AND FIRST TIME HOME BUYER SERVICES.

C. Access Agreements Town of Brattleboro and DVFiber

In a memorandum dated August 31, 2022, Interim Town Manager Patrick Moreland explains the history behind the creation of DVFiber, a Communication Union District (CUD), that includes 24 towns across the Windham Region. This CUD is designed to bring high speed internet to locations that are not currently served by private providers. While the legislature made clear that a CUD could not tax or assess a fee upon participating member towns nor could they receive local tax dollars raised by the towns, member towns were asked to provide space, called Points of Presence. Two sites in the Town of Brattleboro have been identified by project engineers as essential for DVFiber’s development, a location at Central Station and a location on Pleasant Valley Road. Both locations are owned by the Town and Town owned network equipment is already situated there. Staff from Public Works, the Fire Department and the Town Manager’s Office along with Town Attorney Bob Fisher have reviewed the plan and the written agreement and recommend the Board’s approval.

POSSIBLE MOTION: TO AUTHORIZE THE TOWN MANAGER TO EXECUTE TWO POINTS OF PRESENCE ACCESS LICENSE AGREEMENTS WITH DVFIBER, ONE FOR 103 ELLIOT STREET, CENTRAL FIRE STATION AND ONE FOR 718 PLEASANT VALLEY ROAD, AS PRESENTED.
