Brattleboro Selectboard Agenda and Notes – January 3, 2023

The format for the next Representative Town Meeting – in-person, online, or hybrid – will be up for discussion at the Brattleoro Selectboard’s first regular meeting of 2023.  They will also revise the liquor license process and review flagged items on their FY24 General Fund budget list.

You can bring up other items not on the agenda during public participation throughout the New Year!

The Brattleboro Selectboard will meet on Tuesday, January 3, 2023 at 5:45pm and is expected to enter immediately into executive session to discuss collective bargaining and contracts. The Selectboard will reconvene the business part of the meeting at 6:15pm in the Selectboard Meeting Room at the Brattleboro Municipal Center at 230 Main Street. The public may also participate in the meeting over Zoom. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.”  ASL interpreters will be available for deaf and hard-of-hearing community members.

7. CONSENT AGENDA

A. BCA Elections Appointments – Town Clerk’s Office

In a memorandum dated December 12, 2022, Town Clerk Hilary Francis advises that the Selectboard has a statutory obligation to appoint three representatives from any major political party that is lacking that number of elected representatives on the Board of Civil Authority. The appointees will become members of the Board of Civil Authority for election purposes only. The Brattleboro Republican Town Committee has nominated Richard Kenyon, Richard Morton and, Aaron Smith to serve in this capacity from February 1, 2023 to January 31, 2025.

B. Award Engineering Bid – Planning Department

In a memorandum dated December 20, 2022, Zoning Administrator Brian Bannon informs the Selectboard of a public bidding process for involving a Request for Qualifications for design, permitting and construction oversight services for the 250 Birge Street Floodplain Restoration project. The Chosen firm is SLR Consulting of Waterbury, Vermont and the Board is now asked to authorize the Town manager to execute a $94,000 contractual engagement for the stated services. The project is funded in its entirety with Federal and State funding sources.

POTENTIAL MOTION: TO APPROVE THE CONSENT AGENDA, AS PRESENTED.

8. LIQUOR COMMISSIONERS

A. Liquor License Process – Review

In a memorandum dated December 8, 2022 Town Clerk Hilary Francis outlines a number of changes that are needed to the local approval of Liquor Licenses. The Selectboard voted in November of 2017 to have retail establishments submit their Alcohol Sales Policy to the Town Clerk’s Office as part of the liquor license application. Cassandra Holloway of Building a Positive Community and Town Clerk Hilary Francis explain to the Board why this process should be eliminated, and the Board will be asked to reconsider its decision from November 21, 2017. Additionally, an addendum, also authorized by Board action, refers to the previous issue and therefore requires reconsideration. Staff believes that no affirmative action is required of the Board beyond the reconsideration or reversal of the Board’s previous actions.

POTENTIAL MOTION: TO RECONSIDER THE SELECTBOARD’S DECISION OF NOVEMBER 21, 2017 REQUIRING SUBMISSION OF AN ALCOHOL SALES POLICY BY LIQUOR LICENSE APPLICANTS AND TO ELIMINATE THE APPLICATION ADDENDUM THAT REFERENCES SAID REQUIREMENT.

9. NEW BUSINESS

A. RTM Format – Discussion

In a memorandum dated December 27. 2022, Assistant Town Manager Patrick Moreland outlines a decision involving the format of Representative Town Meeting. The decision involves how the meeting is warned, specifically, whether the meeting is warned as all in person or potentially as a hybrid involving the Zoom platform. Town Clerk Hilary Francis, Town Attorney Robert Fisher and Town Moderator David Gartenstein will be in attendance on January 3, 2023 to assist the Board.

B. FY24 General Fund Budget – Flagged Items

In a memorandum dated December 19, 2022, Assistant Town manager Patrick Moreland reviews a number of flagged items where the Board either sought additional information or agreed to consider in more detail at a later date. The Board is asked to consider the items and either request additional information or decide to adjust Staff’s Budget as the Board sees fit.
