Brattleboro Selectboard Agenda and Notes – April 4, 2023

The first regular meeting of the new Brattleboro Selectboard will feature discussions of possible opioid lawsuit settlements, tax increment financing, loose ends from Representative Town meeting, and more.  You can bring up other items not on the agenda during Public Participation.

The Brattleboro Selectboard will meet on Tuesday, April 4, 2023 at 5:30pm and is expected to enter immediately into executive session to discuss contracts and labor relations agreements with employees. The Selectboard will reconvene the business part of the meeting at 6:15pm in the Selectboard Meeting Room at the Brattleboro Municipal Center at 230 Main Street. The public may also participate in the meeting over Zoom. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.”  ASL interpreters will be available for deaf and hard-of-hearing community members.

7. CONSENT AGENDA (6:30pm)

A. Archaeological Services at 250 Birge Street – Authorize Contract

In a memorandum dated March 27, 2023 Planning Director Sue Fillion discusses the redevelopment plan for the floodplain restoration of 250 Birge Steet, the RFP process for this bid and possible sources of funding. She also requests that the Board approve the bid for consultant services for Archeological Monitoring to Hartgen Archeological Associates, NC. for a lump sum cost of $69,5000.

8. NEW BUSINESS (6:35pm)

A. Potential Action Involving Opioid Litigation – Town Attorney

Town Attorney Robert Fisher will update the Selectboard on new developments involving opioid litigation.

B. Vermont League of Cities and Towns Project Based Tax Increment Financing (TIFs) – Presentation (6:45 PM)

Karen Horn, Director of Public Policy & Advocacy for the Vermont League of Cities & Towns (VLCT) will join the meeting via Zoom to describe legislation that would provide municipalities in Vermont with a new tool, a project-based Tax Increment Finance District (TIF). The project based TIF is a simplified version of the existing TIF program and one that VLTC is eager to promote. VLCT has encouraged all towns in Vermont to join them in advocacy of the pending legislation that will enable the new program.

C. Windham Regional Commission – (7:00pm)

(i) Brattleboro Commissioners’ Annual Report to Selectboard

(ii) Appointment of Brattleboro Commissioners for 2023-2024

In a memorandum dated March 17, 2023 Planning Director Sue Fillion presents her annual report to the Selectboard regarding the Windham Regional Commission. The Board is also asked to re-appoint Sue Fillion and Ralph Meima as Brattleboro Commissioners for 2023- 2023.

POTENTIAL MOTION: TO APPOINT SUE FILLION AND RALPH MEIMA AS BRATTLEBORO COMMISSIONERS TO THE WINDHAM REGIONAL COMMISSION.

D. Hazard Mitigation Plan Progress Report and State Mitigation Plan Feedback (7:15pm)

In a memorandum dated March 20, 2023, Zoning Administrator Brian Bannon discusses the Hazard Mitigation Plan. The current plan was approved by FEMA on April 19, 2023 and outlines natural hazards faced by Town residents, ranks the relative threat of these hazards, and identifies projects that address those threats. The Board is asked to review the Annual Progress Report for the Local Hazard Mitigation Plan and provide feedback, if necessary.

E. RTM Follow-up (7:30pm)

The Board will discuss any ongoing and timely matters related to the 2023 RTM.

F. Selectboard Housekeeping (7:30pm)

The Board is asked to assign individual Board members to review, and sign warrants for designated periods throughout the year.

The Board is asked to discuss their Selectboard Goals for the 2023-2024 term of office.

The Board is asked to review and possibly adopt the Rules for Conduct of Meetings and Hearings.

G. Parking Ordinance Change at Community Schoolhouse and Municipal Center – First Reading (8:15pm)

In a memorandum dated March 6, 2023, Planning Director Sue Fillion discusses the background and proposed changes to Chapter 16, Appendix C in the Code of Ordinances. The Board is asked to hold a Public Hearing for a First Reading of changes to the Brattleboro Code of Ordinances Chapter 16, Article VI, Section 2 Parking Meter Areas, Bicycles, Article 1 in General and Article II, Operation and Appendix C, Article 1 Loading and Unloading Zones and Article II, Parking.

H. Tri-Park VCDP – Authorize Application and Public Hearing (8:25pm)

In a memorandum dated March 24, 2023 Assistant Town Manager Patrick Moreland discusses the history behind the Tri-Park Cooperative Housing water and sewer improvements, the current water and sewer project at Tri-Park, indirect beneficiaries, and the project budget. The Board is asked to hold a public hearing regarding this matter, approve an application to the Vermont Community Development Program (VCDP) for an Implementation Grant for the Tri-Park Cooperative and to adopt the resolution from the VCDP for grant application authority.

POTENTIAL MOTION: TO APPROVE AN APPLICATION TO THE VERMONT COMMUNITY DEVELOPMENT PROGRAM (VCDP) FOR AN IMPLEMENTATION GRANT FOR TRI-PARK COOPERATIVE HOUSING CORPORATION IN THE AMOUNT OF $450,000 FOR THE TRI PARK INFILL-RESOLUTION PROJECT. TO ADOPT THE RESOLUTION FROM THE VERMONT COMMUNITY DEVELOPMENT PROGRAM (VCDP) FOR GRANT APPLICATION AUTHORITY, AND TO IDENTITY ASSISTANT TOWN MANAGER PATRICK MORELAND AS THE CONTACT PERSON AND THE AUTHORIZING OFFICIAL.
