Brattleboro Selectboard Agenda & Notes – March 1, 2022

A potentially short regular meeting of the Brattleboro Selectboard is scheduled for Town Meeting Day (election day). They will hear about new plans for liquor for the Latchis Pub & Underground, they’ll talk about wearing masks a while longer, and they’ll amend the ordinance change regarding downtown snow removal. You can add to the meeting by bringing up other items not on the agenda during public participation.

The Brattleboro Selectboard will meet on Tuesday, March 1 , 2022, at 5:30pm and is expected to enter immediately into executive session to discuss the negotiation of a real estate purchase or lease. The Selectboard will reconvene the business part of the meeting at 6:15pm in the Second Floor Meeting Room at the Central Fire Station (103 Elliot Street). Everyone will be required to wear a face covering and maintain social distance. The public is encouraged to participate in the meeting over Zoom. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.”  ASL interpreters will be available for deaf and hard-of-hearing community members.

The following will summarize the proposed motions for the Selectboard meeting on Tuesday, March 1, 2022. The Board will meet in executive session at 5:30pm to discuss the negotiating or securing of real estate purchase or lease options. State Farm Insurance Company Grants – Authorize Application

Limited Access Limited Accessibility Lift (LULA) Project – Accept Bid

Police Cruiser Upfit – Accept Bid

Cemetery Maintenance – Accept Bid

In a memorandum dated February 10, 2022, Fire Chief Leonard Howard requests authorization to apply for a $25,000 grant from State Farm Insurance Company. The grant money will be used to replace the Fire Department’s swift water rescue Zodiac Watercraft, eight new swift water suits and eight swift water vests. This will replace equipment that is twenty years old. By approving this item on the consent agenda, the Board will authorize the application of the State Farm Insurance Company Grants.

In a memorandum dated February 22, 2022, Recreation and Parks Director Carol Lolatte, requests that the Selectboard accept a bid to refurbish and modernize the Limited Access Limited Accessibility Lift (LULA) from Alpha Elevator Company of Montpelier, VT. This company offered two options, option one met the specifications of the RFP and option two added many additional items that will contribute to the smooth running of the LULA. Rec and

Parks staff discussed the improvements with maintenance staff and building consultant Steve Horton, and they recommended the Board accept the bid from the Alpha Elevator Company for option two for $136,828.16. This will put the project over budget by $6,828.16, however even if they go over budget on this project, Rec and Parks will still be under budget by nearly $3000 for Capital Projects for FY22 after all proposed projects are completed. By approving the consent agenda, the Selectboard approves the request to accept the bid from Alpha Elevator Company of Montpelier, VT for $136,828.16 for option two of the LULA Modernization Project.

In a memorandum dated February 22, 2022, Police Chief Norma Hardy requests that the Selectboard accept the bid for a police cruiser upfit from Hard Wired Auto Electronics of Waterville, VT for a total of $35,831.02. This includes all the cruiser upfit in the published RFP as well as additional stickers and paint as well as computers. The current budget for the police cruiser upfit is $45,910, leaving a savings of $10,079. Chief Hardy recommends that this money is used to purchase new dual band radios which would allow the Brattleboro Police Department officers better ways to communicate, including allowing for communication with New Hampshire and Massachusetts authorities. Purchase of the two radios would create a final cost for the upfit at $47,121.34. This is $1211.32 over the allocated budget and the difference will be covered by the fund balance in the Capital Fund. The amount needed to cover this overage is less than the nearly $3,000 savings noted above from other FY22 capital projects. The board is asked to approve the upfit of the two cruisers along with the two radios for a final purchase price of $47,121.34 from Hard Wired Auto Electronics of Waterville, VT. 

In a memorandum dated February 23, 2022, Recreation and Parks Director Carol Lolatte, recommended that the bid for cemetery maintenance be awarded to Independent Landscape and Property Management of South Newfane, VT for $18,350. 

POTENTIAL MOTION: TO APPROVE THE CONSENT AGENDA, AS PRESENTED.

8. LIQUOR COMMISSIONERS

A. Latchis Pub and Latchis Underground – 1st and 3rd Class Liquor License and Annual Entertainment License

The Latchis Pub and Latchis Underground, located at 6 Flat Street, is a new business planning to open in early May. They are seeking a First- and Third-Class Liquor License and an annual Entertainment License. This application has been approved by Brattleboro Police and Fire Departments. Mr. David Ingerman will be present at the Selectboard meeting to address any questions the Board might have.

POTENTIAL MOTION: TO APPROVE A FIRST- AND THIRD-CLASS LIQUOR LICENSE AND AN ANNUAL ENTERTAINMENT LICENSE FOR THE LATCHIS PUB AND LATCHIS UNDERGROUND AT 6 FLAT STREET.

9. UNFINISHED BUSINESS

A. Downtown Sidewalk Snow Removal – Second Reading and Possible Adoption of Proposed Ordinance Amendment

In a memorandum dated February 23, 2022, Town Manager Yoshi Manale recommends that the Selectboard amend the Town Code of Ordinances in Chapter 14, Article 1 Section 14-5 and Chapter 14, Article 1, Section 14-8, regarding the removal of snow and ice from downtown sidewalks, due to increased non-compliance. The proposed changes include changes the Selectboard requested at the first reading of the Ordinance Amendment at the February 15, 2022 Selectboard meeting. This change would allow for the Town’s past practice of having the work performed and billing the property owner, though it also gives the property 24 hours instead of 48 hours to comply, while also including a higher fine for non-compliance.

POTENTIAL MOTION: TO AMEND CHAPTER 14, ARTICLE 1, SECTION 14-5 AND CHAPTER 14, ARTICLE 1, SECTION 14-8 REGARDING THE REMOVAL OF SNOW AND ICE FROM DOWNTOWN SIDEWALKS.

B. Rule Requiring Face Coverings in Indoor Public Spaces – Continue in Full Effect

As required by the Rule Requiring Face Coverings Resolution, the Board will consider whether to extend, modify or repeal the resolution. As required by State legislation that enabled municipal governments to adopt local face covering rules, the Board must pass a motion extending the resolution for another 30 days.

POTENTIAL MOTION: TO EXTEND THE RULE REQUIRING FACE COVERINGS FOR THIRTY DAYS.

10. NEW BUSINESS

A. Committee Appointments

The Board is asked to appoint Tim Kipp as Fence Viewer and Samuel B. Stevens to the Cemetery Committee.

POTENTIAL MOTION: TO APPOINT TIM KIPP AS FENCE VIEWER AND SAMUEL B. STEVENS TO THE CEMETERY COMMITTEE.
