Brattleboro Selectboard Meeting June 20, 2023 – Agenda and Notes

Brattleboro employees will get raises and taxpayers will get a 5% reduction in water bills at the next regular meeting of the Brattleboro Selectboard.

Parking and Utility budgets will be approved, the monthly EMS update will be given, and the public’s chance to weigh in at the 2nd meeting in June regarding EMS services will be on the agenda as well.  You might also be able to bring up other items not on the agenda.

The Brattleboro Selectboard will meet on Tuesday, June 20, 2023 at 5:00pm in the Selectboard Meeting Room at the Municipal Center at 230 Main Street. The public may also participate in the meeting over Zoom. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.” ASL interpreters will be available for deaf and hard-of-hearing community members.

** Please note that the Selectboard meeting will begin promptly at 5:00pm instead of the usual 6:15pm.

B. 250 Birge Street Floodplain Restoration Project Bid Award

In a memorandum dated June 20, 2023, Town Clerk Hilary Francis discusses the Second Class Liquor License, Tobacco License and Tobacco Substitute Endorsement applications for Smoke N Munch, located at 707 Putney Road. Town staff have reviewed this application and recommend its approval. Mr. Sajan will be in the meeting to answer any of the Boardquestions, should this item be pulled from the Consent Agenda. By approving the Consent Agenda, the Board will approve the Second Class Liquor License, Tobacco License and Tobacco Substitute Endorsement for Smoke N Munch, located at 707 Putney Road.

In a memorandum dated June 9, 2023 Zoning Coordinator Brian Bannon discusses the history of the 250 Birge Street Floodplain Restoration Project, as well as past Board actions, the procurement process, costs and funding sources. By approving this item on the Consent Agenda, the Board will be approving two actions: 1. To award the bid for the construction contract to Adams Trucking & Excavating, Inc. for a cost of $1,365,000 and to
authorize the Town Manager to execute the contract. 2. To accept and appropriate a State of Vermont Grant Agreement in the amount of $81,500 to cover the costs of interpretive panels and archeological monitoring.

A. Collective Bargaining Agreement with the New England Police Benevolent Association, Local 412 July 1, 2023 through June 30, 2026 (5:30 PM)

In a memorandum dated June 16, 2023 Town Manager John Potter discusses the collectivbargaining agreement with the New England Police Benevolent Association, Local 412. Primary areas of discussion in negotiations included wages, cost of living adjustments, personal days, longevity payments, the employee percentage of healthcare costs, team incentives, fitness incentives, retirement classification, and promotion minimums.

B. Collective Bargaining Agreement with the Brattleboro Professional Firefighters Association, Local 4439 July 1, 2023 through June 30, 2026 (5:50 PM)

In a memorandum dated June 16, 2023 Town Manager John Potter discusses the collective bargaining agreement between the Town of Brattleboro and the Brattleboro Firefighters’ Association, Local 4439. Primary areas of discussion in negotiations included new and additional steps, cost of living adjustments, paramedic pay scale, wellness days, acting positions, and training contracts. The administration believes that the new wage scale is competitive across the region for these jobs.

C. Collective Bargaining Agreement with the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial, and Services Workers International Union, on behalf of Public Works, Recreation and Parks, and Custodians, Local 944 July 1, 2023 through June 30, 2026 (6:10 PM)


In a memorandum dated June 16, 2023 Town Manager John Potter discusses the collective bargaining agreement between the Town of Brattleboro and the United Steel, Paper and Forestry, Rubber Manufacturing, Energy, Allied Industrial and Services Workers International Union on behalf of Public Works, Recreation and Parks, and CustodiansLocal 944. Primary areas of discussion included wages, cost of living adjustments, the employee percentage coverage on healthcare, vehicle use, clothing allowance, shift differentials, and special assignment pay. If the Board approves the terms of this Memorandum of Understanding, it would be incorporated into a threeyear contract with the union and would cover the period from July 1, 2023 through June 30, 2026.

In a memorandum dated June 16, 2023 Town Manager John Potter discusses the collective bargaining agreement between the Town of Brattleboro and the International Union of Operating Engineers, Local 98. Primary areas of discussion during negotiations included wages, cost of living adjustments, longevity payments, grievance procedures, and union coverage of positions. If approved by the Selectboard, the terms of this Memorandum of Understanding would be incorporated into a threeyear contract with the union and would cover the period from July 1, 2023 through June 30, 2026.

In a memorandum dated June 16, 2023 Assistant Town Manager Patrick Moreland discusses the Community Development Block Grants (CDBG) for two projects from The Windham and Windsor Trust and The Groundworks Collaborative. A public hearing is required at the start of a CDBG and at the end, when a project has been substantially completed. These organizations will meet with the Selectboard and the public to discuss
their project outcomes and to document feedback from the public.

In a memorandum dated June 16, 2023, Town Manager John Potter discusses various elements of the FireEMS Transition Project including: background information, public engagement, a Request for Information (RFI) from potential thirdparty EMS providers, and an initial analysis of startup costs with a Municipal EMS approach.

J. Financial Software (8:25 PM)

In a memorandum dated June 16, 2023 Finance Director Kimberly Frost recommends contracting with Open Gov for updated financial software. This software offers the most comprehensive solution to meet the Towns financial management needs while providing a framework for a more open and transparent budgeting process.

POTENTIAL MOTION: TO AUTHORIZE THE TOWN MANAGER TO EXECUTE A
CONTRACT WITH OPEN GOV IN THE AMOUNT OF $79,500 FOR A FIRST YEAR
LICENSE AND $273,160 FOR THE ONETIME PROCESSIONAL SERVICES
NECESSARY TO CONFIGURE AND IMPLEMENT MODERN FINANCIAL AND ASSET
MANAGEMENT SOFTWARE.

K. Approve Utility Fund Budget (8:45 PM)

In a memorandum dated June 16, 2023 Assistant Town Manager Patrick Moreland discusses the utility fund budget and cash reconciliation for FY24.

POTENTIAL MOTION: TO APPROVE THE FY24 UTILITY FUND BUDGET WITH
REVENUES OF $6,397,750 AND EXPENSES OF $6,478,478, INCLUDING A CAPITAL
PLAN WITH FY24 EXPENSES OF $1,385,750.

L. Utility Rate Ordinance Change, First Reading (9:05 PM)

In a memorandum dated June 16, 2023 Assistant Town Manager Patrick Moreland discusses the proposed ordinance change to the Brattleboro Code of Ordinances, Chapter 18 Water & Sewer, Article III, Water, Division 2 Rates. During the June 6, 2023 Selectboard meeting, the Selectboard determined that a reduction in the rate of increase from the 6% proposed in the existing ordinance to a 1% increase for both FY24 and FY25 was responsible and desirable. The Board is asked to conduct a first reading on this proposed ordinance amendment.

M. Approve Parking Fund Budget (9:15 PM)

REVENUES OF $650,500 AN EXPENSES OF $943,963 INCLUDING AN FY24 CAPITAL
EXPENSE OF $67,525.
