“Presumed Consent” Is NOT “Informed Consent” And The VT State Legislature Should Be Ashamed Of Themselves!

PRESUMED CONSENT OF ORGAN DONATION. OH, REALLY? WHAT A CREEPY WAY FOR THE STATE OF Vermont TO MAKE MONEY because “presumed consent” is NOT “informed consent”!

This Act shall take effect on January 2, 2016. Bill as introduced, H. 57 It is hereby enacted by the General Assembly of the State of Vermont: Sec. 1. 18 V.S.A. chapter 110A is added to read: CHAPTER 110A. ANATOMICAL GIFTS § 5232. PRESUMED CONSENT All Vermont residents 18 years of age or older shall be presumed to consent to making an anatomical gift of some or all of their organs, eyes, tissues, or a combination thereof upon their death for the purpose of transplantation, therapy, research, or education.

§ 5231. DEFINITIONS As used in this chapter: (8) “Refusal” means a record created under section 5234 of this title that expressly states an intent to bar other persons from making an anatomical gift of an individual’s body parts.

OH really? And how many Vermonters will be given an opportunity to create such a record of refusal and how much will it cost them to do so? If it costs so much as one dollar, then this is extortion. HOW MANY PEOPLE WILL KNOW THEY HAVE TO CREATE A RECORD OF REFUSAL TO BE BURIED INTACT? Shouldn’t it be the other way around, that ONLY if you have expressly chosen to give your body parts, then and only then they will take them? “Presumed” consent means that you MIGHT NOT KNOW THEY ARE HARVESTING YOUR BODY! THIS IS RAPE, JUST LIKE WHEN A YOUNG MAN “presumes consent” to force a woman to have sex just because she kissed him. This Bill is a clear violation of the United States Constitution and it violates the separation of Church & State, and it violates every known concept of “informed consent” and “meeting of the minds” when the majority of people will have no idea that Governor Peter Shumlin is harvesting their organs and selling them to the highest transplant bidder!

An indicator shall be placed on the license of any person who has executed an anatomical gift refusal form in accordance with this section.” “5239. Could we get the state legislators to state presumed prices per body part? Remember, they are going to TAKE your body parts WITHOUT your informed consent, and consider them a “gift” from you, and then SELL them to the highest bidder! For example, how much can the state of Vt get for Peter Shumlin’s Penis when he dies, and can the State of VT sell it to a woman who wants it sewn on her groin during a sex change? Let’s get each state senator who is a man to tell us how much we want the state of Vermont to sell HIS penis for, and if the State of Vermont can sell it to men, who think there’s is too short, so they want a transplant for vanity, and not for medical necessity? Can we get the women in the state legislature to whether or not any of them were previously men, and how much would they buy a vagina for from the State of Vermont selling dead women’s vaginas? How much money do you think the state of Vermont can sell Peter Shumlin’s nose for when he’s dead? We can presume he wants an open coffin for his family and daughters to view him with the nose removed?

  • Status of the bill

    Whether intentional or not, Cris Ericson’s report sounds as though this bill was passed and is scheduled to take effect on Jan, 1, 2016. The VT Legislative website reports that the bill has been referred to committee, that there have been no witnesses so far and no role call votes.

    I agree with Ericson that mandatory organ donation is not consensual, even with an opt out. The term, “presumed consent” is Orwellian.

      transparency.

      Just the “implantation” alone could bring an itemized billing charge of hundreds of thousands of dollars per procedure.

      There is NO transparency of WHO is going to make all the money from
      your “gift” of your body parts. Where does the money go? Clearly, this
      is not a humanitarian enterprise, this is all about itemized billing!

    Cris Ericson need not be concerned that the State of Vermont will be selling organs. A source close to Shumlin assured this citizen journalist that, “all organ auctions under H. 57 will be conducted by private corporations.”

    Privatization, explained our source, will satisfy conservatives “who will have no cause to cry, ‘socialism!’” He explained that the business arrangements will be structured in a manner “which benefits progressive initiatives such as education and healthcare.”

    Ericson basically got it right when she lauded Shumlin for this visionary plan to enrich state coffers. But the details do need to be clarified. Under H. 57 the State of Vermont will not be selling organs: The state will be putting contracts out to bid so that private companies can compete for the Kidney Franchise, the Liver Franchise, the Heart and Lung Franchise, the Penis and Nose Franchise, and the Vagina Monologue Franchise.

    Responding to Ericson, our unnamed source assured this citizen journalist that, “we do not anticipate ‘vanity’ penis purchases. Organ transplants — particularly penis replacement — is a serious matter and we expect penis replacement surgery to be used only as a last resort remedy for erectile disfunction.”

    Currently, the State Auditor’s office is preparing a report on projected economic impacts of H. 57. The report is to be published prior the the roll call vote, but sections of the current draft have been leaked to this citizen reporter, including the following:

    “Modern organ banks should be no different from other banks. Organs can be bundled into negotiable securities, so that investors can buy shares in Vermont Kidneys™, Vermont Livers™, and Vermont Spleens™. This will be good for the health of the economy.”

    The draft report touts the program’s social benefits to low income Vermonters:

    “Kidney debit cards can help vulnerable Vermonters, by providing cash now for the monetary value of future organ contributions. Of course, children must be protected, and no organ will be removed from a living child without the express, written consent of at least one parent.”

    In a spontaneous, exclusive interview in the men’s room of the gold-domed Vermont Statehouse, the governor declared: “This Ericson lady has been up my ass and I am sick of it. I am not selling my penis, nor my great nose!”

    Just as the governor was leaving, he turned and added: “Don’t get me wrong, now. I do have skin in the game.”

      Why does this seem so far fetched coming from this state legislature. After all they usually take a left arm or 2 and a couple of pints of blood in taxation in this God forsaken Socialist state. They’ve just figured out a way to tax you when you die.

    • This is a totally serious issue

      I googled “presumed consent” and was rather amazed to find that this is not simply a Vermont initiative, but is part of a much larger effort. There are warnings by medical ethicists about the consequences of mandatory organ donation.

      Opt-outs are notoriously subject to error, and using Orwellian language (“presumed consent”) does nothing to change the reality that it is not about consent at all: It is a government mandate.

      While I sure wouldn’t have wanted to be in Colleen’s shoes it seems the story is more complicated than it appears as posted here and the doctors responsibilities as far as declaring her brain dead were a little more complicated than as posted here. I’m so shocked that there’s a discrepancy. Guess I’ll just go calm down now.
